Mandamus Action on Rehearing: Motion Denied!

BIDEN AND NORTHAM TIPTOE BACK FROM OMICRON RESPONSE, BUT MOTION TO COMPEL PROSECUTOR TO CHARGE SHERIFF DENIED

Even while announcing no mask mandates or restrictions for omicron variant, with record high infection levels, Virginia Governor Ralph Northam stood defiant, stating that 39 fatalities in Virginia was a lot, but offering no reason for his decision not lockdown like he began to do on March 15, 2020, with only 45 reported cases and one fatality. Northam's move followed a similar announcement by the White House, shifting to free testing kits, an admission from VDH that the omicron variant may be more transmissible but not as lethal as the delta variant. This reversal followed a decision to back away from mandates for child vaccines. And, meanwhile, the White House is under an order to respond to matters raised before Justice Kavanagh on the DOL vaccines mandate no later than 4 p.m. on December 30th, an action in which what will be our fourth action at the Supreme Court will be filed no later than Friday, as an intervenor.

But, a decision of the prosecutor for the City of Alexandria to refuse to even investigate allegations regarding the sheriff failing to serve process on the Governor in the first filed and longest surviving litigations against the lockdowns in the Commonwealth, commenced on April 2, 2021, was affirmed by the court, dismissing a motion for reconsideration, which provides more time for other actions of the defendants while the matter goes up on appeal, and preserves the reputation of the presiding judge, who has a reputation of being a pretty hardline jurist, and an expected outcome in the reality of litigation.
