The guitar manufacturer, Gibson, has filed a lawsuit against the owner of Dean and Luna Guitars, Armadillo, for trademark infringement and counterfeiting. Gibson alleges that Armadillo created and sold guitars that copied the shape and style of Gibson guitars.

The guitars in question have been on the market for over 4 decades, and Gibson is no stranger to suing copycat guitar creators. They have even sued toy makers for copying their design.

Armadillo argues that Gibson’s trademarks are far too general. The ‘Flying V’ and ‘Explorer’ shapes have been used by many guitar manufacturers, and therefore should not be trademarkable.

Andrei Mincov (the founder of Trademark Factory®) talks about this trademark screwup, and how through companies protect their rights/brand with trademarks.
