Did Tom Brady Screw Himself out of a Trademark?

When Tom Brady’s company filed to trademark his nickname “Tom Terrific,” it seemed like it would be an easy win. One problem: Fans of Tom Seaver, the famous Hall of Fame pitcher, believe that the name belongs to him.

In an attempt to defuse the frustration surrounding the name, Brady told reporters that he didn’t even like the nickname, indicating that the trademark had only been filed to prevent others from using it.

Unfortunately, when filing a trademark, you have to display a bona fide, good faith intent to use the trademark. Declaring that the name was only being trademarked to prevent others from using it will make enforcing this trademark incredibly difficult, and could cause legal troubles for Brady and his team down the road.
