Attorney General's Office Releases Video Of Officers Fatally Shooting Man In Newton

Bodycam footage shows the moments that led to officers fatally shooting a man at a home in Newton July 4, with video released Monday showing the man point what appeared to be a gun before officers opened fire, striking and killing him.

Gulia Dale III, 61, a U.S. Army veteran, was shot by Newton officers Steven Kneidl and Garrett Armstrong shortly after 9:30 p.m. after he refused their orders to get out of his truck, according to bodycam and dashcam footage released by the Attorney General's Office on Monday.

Dale was backing out of his driveway in a red four-door Toyota pickup truck when officers arrived on scene: one patrol car blocked him from behind and another from the front. A third officer arrived just seconds before the shooting occurred.

Pointing his gun at Dale, who was still in the driver's seat, an officer could be heard yelling "Get out of the truck" eight times and urging him to "get on the ground" twice.

Dale emerged from the driver's-side door, opened up his rear door and appeared to grab an object, the body cam footage shows. Dale then started to sit in the driver's seat before quickly turning to the officer with both arms raised, holding an object that appeared to be a weapon.

The action led Armstrong and Kneidl to fire multiple rounds — at least seven rounds could be heard on video — before an officer yells out "Shots fired, shots fired" as Dale drops to the ground. The officer then yells out "he's dead, he's down" before the officer is seen kicking a black object away from Dale's body, declaring, "got a gun, got a gun, got a gun." A .45-caliber Glock 21 firearm was found near Dale's body, the Attorney General's Office said.

Police initially responded to the home after a family member called 911. The family member tells the dispatcher Dale has a gun on him and calmly asks "please get the cops here," according to an audio recording of the 911 call.

The woman can be heard on the call talking to "Guly" and telling him "the cops are on their way, for you, because you're acting crazy." The woman stops speaking to the dispatcher about 30 seconds before gunshots can be heard in the background and the dispatcher declares "shots fired" to officers heading to the scene from Andover Township and the New Jersey State Police.

The Attorney General's Office released video and audio recordings following a request by the New Jersey Herald.

Members of Dale's family and their attorney viewed the video recordings on July 30, the Attorney General's Office said. The independent investigation remains active and once complete, they will present recommendations about whether any officers should be criminally charged. In fatal use of force shootings, it will be up to a grand jury to decide if any of the officers should be criminally indicted.

Kneidl has been a member of the Newton Police Department for three years, and Armstrong since October 2020, records show.

Dale, who was raised in Montclair and attended Orange High School, joined the U.S. Army before being honorably discharged in 1982, according to his obituary. Dale joined the National Guard and served for 25 years before retiring in 2004 with the rank of Major.

Dale was activated on 9/11 and served several months of active duty in Iraq, his obituary states. He was employed at Picatinny Arsenal, a military research and manufacturing facility in Morris County. He also worked as an equal opportunity specialist at the Department Joint Chiefs of Staff at the Pentagon in Washington, D.C. Previous requests for comment from both Picatinny and the Joint Chiefs of Staff went unanswered.

Dale leaves behind a wife and two daughters.
