Here is my oral comment for 6. Public Comment to the Board of Supervisors on May 11, 2021. I was made to stand in the hot lobby (air conditioning wasn’t working in the lobby), they took a break and we had to wait until 2:00 to speak (we were there at 8 a.m.), and they had serve technical difficulties with the audio (BOS and people in the lobby could not hear) I originally sent this to them October 9, 2020.

Butte County Board of Supervisors:

There is NO emergency and never has been an emergency regarding Covid-19 in Butte County. Instead of being concerned about funding - your greater concern should be following the law. You are breaking several state and federal laws by continuing to fake a medical emergency for funding. There currently are public officials in prison, and you are not immune from the law.

Below I will list just a few of the many laws on the books that you and counsel should educate yourselves on. Malfeasance is grounds for dismissal.

18 U.S. Code 1040 - Fraud in connection with major disaster or emergency for benefits and get funding. This is a crime and you could be charged with 30 years in prison.

18 U.S. Code 1038 - False information and hoaxes. The hoax in this case is there is no emergency. This is enforced by the F.B.I. and Homeland Security. The penalty could be life in prison.

Health and Safety Code 101080 - Requires you, by law, to terminate emergency at the earliest date. You blatantly have not done this even after repeated requests from your constituents.

Penal Code 148.3 - False reporting an emergency. Let me reiterate - there is no emergency in Butte County.

Title 18 U.S.C., Section 242 - Deprivation of Right under Color of Law - ...local officials...if the acts are done...while purporting to or pretending...of official duties.

Government Code Section 8630 - ...termination of the local emergency at the earliest possible date.

42 U.S. Code 1986 - Action for neglect to prevent...

Title 18 U.S.C. Section 241 - Conspiracy against rights...

Government Code Section 8630 - Calling for a local emergency when there really isn’t one. This is against the law.

Not providing “relevant information” to governmental entities, as required by HSC Div. 105, Part I, Chapter 3 Section 120175.5 which directs the health officers to provide evidence and information to the governing body regarding communicable diseases. Board of Supervisors are complicit in violating this California law.

Emergency Services Act 8558 b - Calling for a local health emergency when there are no legal grounds.

If you participate in disaster fraud you can loose your positions as county supervisors and be prosecuted criminally. You are not above the law. I strongly urge you to do what is right, and put the citizen of this wonderful Butte County first. If not, I ask you to resign from your positions so we may get ethical, trustworthy representation.
