Senators were originally chosen by state legislatures until gridlock in those legislatures resulted in Senate seats remaining vacant for far too long. But the solution Congress and the States implemented was worse than the problem: The 17th Amendment greatly distorted the function of the Senate as a bureaucratic reality check on popular aspirations. The Cultural Bill of Rights restores the balance by repealing the 17th Amendment and solving the original problem of gridlock in a minimalist fashion that preserves our federal system.
