The Fifth Amendment of the Constitution implicitly states that the government can take private property for public use. But what constitutes "public use"? The Supreme Court, lacking a clear Constitutional definition, has made some questionable judgments concerning what "public use" means. The Cultural Bill of Rights will supply the Constitution with the "public use" definition it presently lacks.
