Michigan Judge Confirms Trump’s Charges, 3543

A Michigan judge has confirmed President Trump’s charges that Michigan Secretary of State, Jocelyn Benson’s orders issued a month before the last presidential election concerning how signature verification on mail-in ballots would be handled by county clerks to be invalid because the Sec. of State lacked the authority to overrule the laws of the state.
According to the written ruling issued by Judge Christopher Murray, the chief judge of the Michigan Court of Claims:
“The standards issued by defendant Benson on October 6, 2020, with respect to signature-matching requirements amounted to a ‘rule’ that should have been promulgated in accordance with the APA.” The APA refers to the state’s Administrative Procedures Act.
A lawsuit was filed on Nov. 2, 2020, the day before Election Day, by the Michigan Republican party and Allegan County Clerk of the Court, Robert Genetski.
On Oct. 6, 2020, Benson sent out guidance to County Clerks statewide that signatures on mail-in ballots must be considered to be the voter’s genuine signature unless they could prove that the signatures:
“… differ [in multiple], significant and obvious respects from the signature on file.”
