A Federal Judge In Ohio Has Ruled That The CDC Did Not Have The Authority To Order A Moratorium On Evictions During The Coronavirus Shutdowns.

According To U.S. District Judge J. Philip Calabrese, The CDC's Order Went Beyond What The 'Federal Public Health Service Act' Allows The Agency To Do.

In A Statement, The National Association Of Homebuilders Said,

"Saddling Landlords With The Responsibility To Provide Free Rent During This Pandemic Ignores Their Financial Obligations And Ability To Provide Safe, Decent And Affordable Housing," They Added "Even During Emergencies, Federal Agencies Must Abide By The Law."

The NAHB And A Group Of Property Owners From Across Northern Ohio Called The Moratorium Overreaching And Arbitrary.

Judge Calabrese Isn't The First One To Make This Type Of Ruling As An Eastern Texas Judge Also Ruled The Eviction Moratorium Was Unconstitutional.

However The President Of The National Low-Income Housing Coalition Said,
"Attempts To Overturn The Moratorium Are Frivolous" Because Tens Of Billions Of Dollars In Federal Rental Assistance Are Coming In On The Recently Passed Covid-19 Relief Bill.
