GIGOT: “Practice foreign policy issue, and may come down to that for some the conservative justices because Chief Justice Roberts for example was given a lot of deference to the president when it comes to foreign policy but my problem with that is, tariffs are a tax year old caps on importers are they going to say the president can use that power on his own without approval from Congress, Dan?”

HENNINGER: “If they said that essentially that would say presidential authority is limitless. I don’t think any of the justices are willing to go that far which essentially would reduce Congress I think especially the conservative members of the court would like to see and be clear about the laws it writes Congress should be clearer about what exactly tariffs authority consists of. The president is arguing that all of his tariffs are an emergency but I think the court is going to focus to a great extent on the meaning of emergency keep segment vento and drugs pouring across the border and somein some arguable sense t an emergency but all of these other tariffs on Europe, Canada, reciprocal tariffs are about goods where the deck and fall under the heading of a national emergency I think is a real stretch.”
