Does the Crown have "autochthonous" title to the land of Canada or do they have absolute tile?

1. Two Types of Title: Autochthonous vs. Absolute
• Autochthonous title means a title or authority that arises from the land itself — that is, inherent and originating within the territory. It's self-generated, not derived from anyone else's grant or authority.
• Example: Indigenous peoples' Aboriginal title is autochthonous — it arises from their historic occupation and relationship with the land, predating the Crown.
• Absolute title (or radical title, in common law terms) refers to the underlying legal ownership of land in a sovereignty system, often associated with the Crown. It's not "autocthonous" because it derives from the assertion of sovereignty — in Canada's case, through colonization and the extension of the British Crown's legal order.

2. What the Crown Actually Has: Radical (Not Autochthonous) Title
Under Canadian law, the Crown does not have autochthonous title. Its title is asserted, not inherent — it stems from the act of claiming sovereignty over the land (via discovery, occupation, or cession), not from the land itself.

The Supreme Court of Canada clarified this in Delgamuukw v. British Columbia (1997) and Tsilhqot'in Nation v. British Columbia (2014):

• The Crown acquired "radical title" (the underlying title to all land in Canada) when it asserted sovereignty.
• However, that radical title was burdened by pre-existing Aboriginal title, which the Crown did not extinguish automatically.
• Aboriginal title, being autochthonous, survives unless lawfully extinguished.
So:

The Crown's title is derivative (from assertion of sovereignty) and qualified (subject to Aboriginal title).
It is not absolute and not autochthonous.

Brothers and Sisters,

The time for truth has come. The Sovereign Kawatha First Native Nation stands firm in declaring that those who violated their oaths of office and betrayed the people of Canada and the United States during the COVID-19 period must face lawful accountability for their actions.

We are witnessing the collapse of a corrupt political and judicial structure that for too long has served corporate and foreign interests instead of the People. Government officials, medical authorities, and their partners who authorized or concealed the use of experimental mRNA biological materials on citizens—without full disclosure or consent—have committed acts that rise to the level of crimes against humanity under international law.

Our position is clear:

These were not vaccines in the traditional sense, but unproven genetic technologies that have caused death and injury among innocent men, women, and children.

Those in public trust who allowed or enforced these measures must be investigated by independent international and military tribunals for violations of the Nuremberg Code, the Universal Declaration of Human Rights, and the Geneva Conventions.

The evidence of harm and negligence continues to grow, and it will be presented through lawful courts and international venues.

The Kawatha First Native Nation stands in solidarity with Indigenous and non-Indigenous investigators across Canada and the United States who are collecting testimony, medical data, and documentation to ensure that justice is achieved for all who suffered loss during this dark chapter of history.

We thank the Creator for giving us courage, and we remind all Peoples of Turtle Island that truth cannot be silenced. The so-called "authorities" who believe they are above the law will soon answer to a higher one—both earthly and divine.

This is not a call for anger, but for unity, exposure, and lawful conquest through truth. Our next steps will include formal submissions to international bodies, legal petitions, and the continued demand for full accountability.
