In this instalment of the Power and Occultism series, we look at the judicial trial as an occult ritual, since there is nothing scientific about it. In particular, it is a Satanic ritual, as Satan literally means lawyer. Satan’s mortal sin is to prosecute man (Adam) and play God: the judge.

A trial is a ritual that is meant to determine if the accused is guilty, which is a question of science, not law, to the extent that guilt implies that the accused did something harmful. The ritual ends with the sacrifice of a party’s person or property.

In the end, only two facts—which are the province of science—are relevant; namely, the quantum of damages and the cause(s). From a scientific standpoint, the judiciary is a waste of resources and a danger to society, since jurists and police are third parties whose opinions have no scientific merit. Legal advocacy and judicial decision-making are also very costly and intrinsically speculative and biased. Putting police or jurists in charge of cases thus gives them powers they shouldn’t have and puts them in positions for which they are not qualified and where they should not be involved. The solution is to reduce the role of police to security and replace the judiciary with forensic science.

However, since police and lawyers have comfortable jobs, reforming them is not the easiest way to implement the solution. Rather, the easiest way to do so is to use available alternatives. For instance, replacing jurists with forensic science would only reinvent the wheel of Islamic law.

Systems of law tend to decrease in number over time, as laws are tested and tried over the centuries. Thus, while laws may vary, a new system of law is not likely to be developed in the future.

Scriptures or laws tend to proliferate like their followers. For instance, if Islamic law is a force of life, as it claims, then it will spread unstoppably, as it does. The simplest solution, therefore, is not to reform moribund laws (that is, to beat a dead horse) but to arbitrate with Qadis, who are domain experts, and not to make any contracts without an arbitration clause, which is required for Muslims (Qur’an 4:65).

While common law is quickly disappearing because it is costly, arbitrary and barbaric, Islamic and civil law remain. However, civil law only remains in form—notably, the idea of a code, which many people find useful for indexing laws—whereas the form and content of Islamic law remain. Trial by expert, which is the basis of Islamic law, is bound to prevail over trial by Satan, which evolved from common law duels and civil law inquisitions.
