Appealing Chair Horn for the 75% Threshold to Adopt the Motion Respecting the Will of the Assembly
Motions, questions of the body, normal pass on a simple majority. Chair Horn at the opinion of the parliamentarian set the threshold to 75%. This appeal from Jefferson County was to seek correction to this and set the level back to a simple majority as is customary for all motions.
Interestingly, the executives of the state party kept referring to this as a 51% vote and they have all been in this business long enough to know that any number over 50% is a simple majority.

Perhaps the confusion is that in Colorado Statutes the opt-out vote requires 75% requires a 75% vote of the entire State Central Committee but that is not the motion at hand. The motion at hand is 'should the State Central Committee respect the will of the higher body, being the assembly of delegates elected to directly represent the Republicans across the state.'
The assembly is a much larger body and far closer to the general public as they were elected by the public. Their authority, aside from the obvious, is stated in Colorado Revised Statutes § 1-3-106 (2) which says, in part, "The state convention of the party may also provide rules that shall govern the state central committee in the exercise of the powers conferred upon the committee in subsection (1) of this section." The words 'convention' and 'assembly' are used almost identically in C.R.S. Subsection 1 that is mentioned is giving the State Central Committee authority to conduct business and resolve controversies of the party.
