A North Andover cop shot in the chest by her own colleague is now locked up for 180 days—not because she drank, not because she broke bail, but because she physically couldn’t blow hard enough into a SCRAM breathalyzer. Kelsey Fitzsimmons, still healing from collapsed lungs, broken ribs, and a liver injury, dragged herself back to court in good faith to ask for an alternative alcohol test. Instead, Judge McCarthy-Neyman accused her of “manipulating” the system, cut off her lawyer, berated probation, and literally walked off the bench mid-hearing.

Probation backed her. The DA didn’t ask for jail. The medical evidence was clear. Still—she was thrown back behind bars as “a danger to the community.”

Now her defense says the court not only broke Massachusetts bail law, but also violated the Americans with Disabilities Act by refusing to accommodate her injuries. Add in the fact that she’s a police officer and former CO—making her a target inside prison—and this case looks like a disaster waiting to happen.
