Signed into law by Governor Gavin Newsom in September 2025, this landmark legislation introduces a framework designed to balance innovation with public safety, ensuring that the rapid evolution of AI technology is met with accountability and transparency.

SB 53 represents a carefully negotiated compromise following earlier debates around AI regulation. While a previous proposal, SB 1047, was vetoed for being overly restrictive, SB 53 refines those ideas into a practical system of oversight. Its primary focus is on frontier AI models—the most advanced systems with capabilities that could potentially cause widespread harm if misused or left unchecked.

Under the new law, AI developers operating at the frontier level are required to disclose their safety and risk mitigation strategies. This includes assessments of catastrophic risks, defined as incidents capable of causing more than $1 billion in damages or resulting in the deaths of at least 50 people. By mandating these disclosures, California is setting a precedent for transparency that could inspire federal and international standards.

One of the law’s most critical elements is the requirement for incident reporting. Developers must notify California’s Office of Emergency Services within 15 days of any significant safety event linked to their AI systems. This ensures that emerging risks are identified quickly, preventing small issues from snowballing into large-scale crises.

To further strengthen accountability, SB 53 provides whistleblower protections for employees of AI companies. Workers can now report concerns about safety, misuse, or negligence without fear of retaliation, an important safeguard in an industry where insider knowledge may be the first line of defense against harm.

The bill also invests in equitable access to AI resources. Through CalCompute, a public cloud cluster hosted by the University of California, researchers, startups, and public institutions will gain affordable access to advanced computing power. This democratizes AI development, reducing the dominance of a handful of tech giants and fostering a more inclusive innovation ecosystem.

By enacting SB 53, California has positioned itself not only as the hub of AI innovation but also as the first U.S. state to codify AI transparency and safety laws. This move signals a new era in which technological progress will be guided by responsibility, transparency, and public trust—principles that are likely to influence AI governance worldwide.
