On September 10, 2025, Florida’s First District Court of Appeal struck down the 1987 law banning open carry.

Attorney General James Uthmeier has declared the ruling applies statewide and has advised law enforcement to cease enforcement of the open-carry ban.

The new open carry law becomes effective September 25, 2025. After that date, legal gun owners can openly carry in many public spaces.

Still prohibited: open carry in schools, government buildings, courthouses, bars, and certain private businesses that explicitly ban firearms on their premises.

Be mindful: improper display (threatening, careless, or in anger) remains illegal under Florida law.
