(0:18) Calling case 251403576, State of Utah v. Tyler James Robinson. (0:27) Could you state your name? (0:29) Tyler James Robinson. (0:30) Thank you for being here, Mr. Robinson.
(0:34) I'm Judge Graf. (0:37) Mr. Skourtis. (0:39) Good afternoon, your honor.
(0:40) You're probably already aware of my presence or why I'm here. (0:43) But if not, I am not entering an appearance. (0:45) I'm not counsel on this case.
(0:46) I'm working with the county to get counsel assigned. (0:52) But we need you to allow for the appointment of counsel. (0:56) Thank you, Mr. Skourtis.
(0:59) Well, I want to go through the qualifications for indigent. (1:05) But that is my intent, Mr. Skourtis. (1:07) And I thank you for being here.
(1:10) So, Mr. Robinson, you have a right to an attorney. (1:13) If you cannot afford one, the court can appoint an attorney to represent you. (1:17) I have reviewed your declaration of financial status and find that you are indigent.
(1:22) I'm provisionally appointing a Rule 8 qualified attorney to represent you on your case, Mr. Robinson. (1:31) Along with the filing of their appearance of counsel, (1:34) the assigned attorneys must file declarations with the court that outline their qualifications under Rule 8 and Rule 8C. (1:42) I'm sorry, under Rule 8B and Rule 8C for a counsel appointment in a case where death may be a sentencing option.
(1:51) I'm ordering that those declarations be filed prior to the next hearing, which is set for September 29th at 10 a.m. (2:01) Mr. Robinson, I also wish to inform you of your rights against self-incrimination. (2:06) Anything that you say in court today could be used against you, and we want to protect your constitutional rights. (2:13) Mr. Robinson, at this time, you will remain in custody without bail.
(2:19) Mr. Skourtis, is there any other points that you wish to address? (2:23) No, thank you very much, Your Honor. (2:25) Turning to the state. (2:29) Yes, Your Honor.
Chad Grunander for the state. (2:31) I'm also joined, and they're listed as attendees, Ryan McBride, Lauren Hunt, David Sturgill, and Chris Ballard. (2:39) We are the trial team on this case.
(2:53) It should be in your queue, Your Honor, and sign that. (2:57) Thank you. (2:59) I have reviewed the pretrial protective order and will be grant-issuing this pretrial protective order in favor of Erica Kirk.
(3:08) Is there any other business that we need to address today, Counsel? (3:12) Just for the court's information, we did file just recently within the last few minutes a notice of intent to seek the death penalty. (3:19) That was filed by Utah County Attorney Jeff Gray, so that should be in the court's file. (3:28) Lastly, I would just indicate to the court and to, at this point, Mr. Robinson, that we are prepared to collect all of the discovery in this matter (3:37) and get that turned over to the defense as soon as possible.
(3:40) Rule 16 requires us to provide what we have relied on in charging the information and bringing these charges within five days once it's requested, (3:51) so that will be prepared to disseminate to the defense as soon as possible. (3:56) Thank you, Mr. Girander. (3:58) Mr. Robinson, what I also want to do is you have the right to have the charges read that you stand charged of, (4:07) and I wish to read those to you at this time.
(4:22) Mr. Robinson, for count one, aggravated murder, a capital felony in violation of Utah Code Annotated 76-5-202, (4:33) in that on September 10, 2025, in Utah County, the defendant, Tyler James Robinson, (4:40) intentionally or knowingly caused the death of Charlie Kirk under the following circumstances. (4:47) The defendant knowingly created a great risk of death to another individual other than Charlie Kirk and the defendant. (4:54) Notice conviction of this offense may carry the death penalty for pursuant to Utah Code 76-3-207.7, (5:02) a mandatory term of imprisonment for life without parole or an indeterminate term of not less than 25 years that may be for life.
(5:16) Victim targeting enhancement in violation of Utah Code Annotated 76-3-203.14, sub 2. (5:24) Tyler James Robinson intentionally selected Charlie Kirk because of Tyler James Robinson's belief or perception regarding Charlie Kirk's political expression. (5:37) Notice if the trier fact finds beyond a reasonable doubt that the victim targeting enhancement applies, (5:43) the sentencing judge or the board of pardons and parole shall consider the defendant's selection of the victim as an aggravating factor. (5:50) Violent offense committed in the presence of a child aggravating factor, (5:55) the sentencing judge or the board of pardons and parole shall consider as an aggravating factor in their deliberations (6:01) that the defendant committed a violent criminal offense in the presence of a child.
(6:06) Count two, felony discharge of a firearm causing serious bodily injury, (6:12) a first degree felony in violation of Utah Code Annotated 76-11-210, sub 2 and 3C, (6:22) in that on September 10th, 2025 in Utah County, (6:26) the defendant Tyler James Robinson discharged a firearm in the direction of Charlie Kirk, (6:31) knowing or having reason to believe that Charlie Kirk may be endangered by the discharge of the firearm (6:38) and that the act caused serious bodily injury to Charlie Kirk. (6:43) Victim targeting enhancement in violation of Utah Code Annotated 76-3-203.14, sub 2. (6:52) Tyler James Robinson intentionally selected Charlie Kirk (6:55) because Tyler James Robinson's belief or perception regarding Charlie Kirk's political expression. (7:02) Notice if the trier fact finds beyond a reasonable doubt that the victim targeting enhancement applies, (7:08) the sentencing judge or the board of pardons and parole shall consider the defendant's selection of the victim as an aggravating factor.
(7:16) Violent offense committed in the presence of a child aggravating factor, (7:20) the sentencing judge or the board of pardons and parole shall consider an aggravating factor in their deliberations (7:26) that the defendant committed a violent offense in the presence of a child. (7:31) Count three, obstruction of justice, (7:34) a second degree felony in violation of Utah Code Annotated 76-8-306, sub 2, (7:42) in that on September 10th, 2025 in Utah County, (7:45) the defendant Tyler James Robinson with intent to hinder, delay, or prevent the investigation, (7:52) apprehension, prosecution, conviction, or pursuit to any person regarding conduct that constitutes a criminal offense, (8:00) conceal or remove the firearm used to shoot Charlie Kirk, (8:03) and the conduct that constitutes an offense would be a capital felony or a first degree felony. (8:09) Count four, obstruction of justice, (8:12) a second degree felony in violation of Utah Code 76-8-306, sub 2, (8:19) in that on or about September 11th, 2025 in Utah County, (8:23) the defendant Tyler James Robinson with an intent to hinder, delay, (8:28) or prevent the investigation, apprehension, prosecution, conviction, (8:33) or punishment of any person regarding conduct that constitutes a criminal offense, (8:38) destroyed, concealed, or removed the clothing he wore during the shooting, (8:43) and the conduct that constitutes an offense would be a capital felony or a first degree felony.
(8:50) Count five, tampering with a witness, (8:53) a third degree felony in violation of Utah Code Annotated 76-8-508, (8:59) in that on or about September 10th, 2025 in Utah County, (9:04) the defendant Tyler James Robinson believed that an official proceeding (9:08) or investigation was pending or about to be instituted (9:13) or intended to prevent an official proceeding or investigation (9:16) and attempted to induce or otherwise cause his roommate to withhold testimony, (9:22) information, a document, or an item to it, (9:26) directing his roommate to delete incriminating text messages. (9:30) Count six, tampering with a witness, (9:33) a third degree felony in violation of Utah Code Annotated 76-8-508, (9:40) in that on or about September 11th, 2025 in Utah County, (9:44) the defendant Tyler James Robinson believed that an official proceeding (9:49) or investigation was pending or about to be instituted (9:52) or intended to prevent an official proceeding or investigation (9:55) and attempted to induce or otherwise cause his roommate (9:59) to withhold testimony or information to it, (10:04) directing his roommate to stay silent if the police questioned the roommate. (10:10) Count seven, violent offense committed in the presence of a child, (10:14) a class A misdemeanor in violation of Utah Code Annotated 76-3-203.10, (10:22) sub 2, and 76-3-203.14, sub 3A, double I, (10:30) in that on or about September 10th, 2025 in Utah County, (10:34) the defendant Tyler James Robinson committed criminal homicide (10:38) in the physical presence of a child younger than 14 years of age (10:43) with knowledge that a child was present and that may have been seen (10:47) or heard the commission of the criminal homicide (10:51) victim targeting enhancement in violation of Utah Code Annotated 76-3-203.14, (11:00) sub 2, Tyler James Robinson intentionally selected Charlie Kirk (11:05) because of Tyler James Robinson's belief or perception (11:08) regarding Charlie Kirk's political expression.
(11:12) That concludes reading the information. (11:16) Mr. Robinson, this case is set for September 29th at 10 a.m. (11:23) It will be a waiver hearing, and I will be the judge assigned to this case. (11:29) Mr. Robinson, I invite you to join us at that time.
