Jussie Background Information:
Jussie Smollett is an actor known for his role in the TV show Empire who, in 2019, staged a fake hate crime against himself in Chicago. The case involved multiple legal proceedings, a conviction, a brief jail sentence, and an eventual reversal of the conviction on procedural grounds.
Initial claim and investigation
The alleged attack: In January 2019, Smollett, who is Black and gay, told police he was attacked by two masked men late at night. He claimed they yelled racist and homophobic slurs, poured bleach on him, and put a noose around his neck. The men allegedly shouted, "This is MAGA country," a reference to former President Donald Trump's campaign slogan.
Police suspicion: After a two-week investigation, Chicago police grew skeptical of Smollett's story due to inconsistencies and a lack of corroborating evidence.
The brothers' testimony: Police tracked down two brothers, Abel and Ola Osundairo, who had worked as extras on Empire and knew Smollett. The brothers confessed that Smollett had paid them $3,500 to stage the attack. Smollett's defense claimed the payment was for personal training services.
Legal twists and turns
First charges and dismissal: In February 2019, Smollett was arrested and charged with felony disorderly conduct for filing a false police report. The Cook County State's Attorney's office later dropped all charges in exchange for Smollett forfeiting his $10,000 bond and completing community service. The decision caused an outcry from Chicago's police and then-mayor.
Special prosecutor and new charges: A special prosecutor was appointed to review the case. In February 2020, Smollett was indicted again on six counts of felony disorderly conduct.
2021 conviction: After a trial, a jury found Smollett guilty of five of the six counts. The prosecution argued he staged the attack for publicity.
Sentencing and release: In March 2022, Smollett was sentenced to 150 days in jail and ordered to pay restitution. He served only six days before being released pending an appeal.
Overturned conviction and settlement
Conviction overturned (2024): In November 2024, the Illinois Supreme Court overturned Smollett's conviction. The court ruled that prosecuting him a second time after the initial charges were dropped constituted a due process violation. It did not rule on his innocence but concluded that the state must honor agreements made with defendants.
Civil suit settled (2025): The city of Chicago filed a civil suit against Smollett seeking compensation for investigation costs. In May 2025, Smollett settled the suit by making a charitable donation.
Smollett's defense: Smollett has consistently maintained his innocence, claiming he was a victim of a real hate crime. He also argues the second prosecution was "vindictive".
Outcome
While Smollett's criminal conviction was reversed on procedural grounds, his career was severely impacted. The civil case with Chicago was settled, though he continues to claim innocence. The events led to widespread public debate on race, justice, and celebrity.
