These are the kinds of people adjudicating against "We the People" without due process, or a Trial by Jury of our peers. A hearing officer who even though 2x in 2018 AND 2023 crashes his car almost three times the legal alcohol limit, he still adjudicates against people as a judge.

On Monday, January 2nd 2023 around 1827, Tri-Cities (Washington) Judge Terry M Tanner was reported for driving onto a jersey barrier at a service station in Richland, Washington.

What follows is Officer Denlow's report, and BWC footage from the arrest.

On 1/2/2023 at approximately 1827 hours, I was dispatched to a single vehicle collision at 2607 Kingsgate Way, Richland, WA. Dispatch advised the vehicle had high centered on a concrete block.

Upon arrival, I contacted Richland FD Medics who advised they could smell the odor of intoxicants emitting from the male. Medics also advised the male is diabetic and his blood sugar was low, but not to the point where it would cause him to have a collision.
I spoke with the witness on scene, Travis S, who advised he saw the male in the driver seat of the vehicle while it was high centered on the block and the wheels were still spinning. Travis assisted in removing the male from the vehicle and had him sit on a cement block nearby.

I later identified the male as Terry M. Tanner. When asked, Terry advised the vehicle was not his and he was not driving. When asked, Terry stated he did not know whose vehicle it was. I had dispatch run the WA State LIC #W15XXX, which listed the registered owner as Terry. While speaking with Terry, I noticed his eyes were watery and his speech was very slurred, and his eyelids were very droopy. Terry swayed left and right as he sat. When asked, Terry did not consent to completing voluntary Standardized Field Sobriety Testing. He also did not consent to a PBT.

At approximately 1849hrs I told Terry he was under arrest for Physical Control. I placed Terry into handcuffs, checked them for spacing, and double locked them. I had to assist Terry in walking to my patrol car as he almost fell over multiple times. I searched Terry incident to arrest and did not locate any weapons or contraband. While searching Terry, I had to hold him upright, as he almost fell multiple times.

I transported Terry to the Benton County Jail for the DUI process. While transporting Terry to the Benton County Jail, I could hear him sleeping and snoring in the back seat of my patrol car. Upon arriving to the jail, as Terry was getting out of the back of my patrol car, he fell into me twice and then
the rear passenger quarter panel of my patrol car. I had to hold Terry with both hands as it appeared he could not stand on his own.

At around 1916hrs I turned on the Drager machine. I began observing Terry at this time. I looked in his mouth and saw there was nothing inside. Terry did not put anything in his mouth during the
entire DUI process.

I read Terry his Constitutional Rights from the DUI packet. Terry told me he understood his rights and signed the packet. He did not express any confusion and did not request an attorney. I then read Terry his Implied Consent Warnings for breath, he stated he understood and signed the packet. Terry agreed to submit to the breath test.

I entered the required information into the Drager machine and began the test. At around 1936hrs Terry provided the first breath sample. The test showed an IR result of 0.220 and an EC result of 0.225.
At around 1941hrs Terry provided the second breath sample. The test showed an IR result of 0.232 and an EC result of 0.237.

I prepared a criminal citation for Physical Control and booked Terry into the Benton County Jail. I provided Terry with a copy of the Drager results, his driver's hearing request information, and the citation for Physical Control.
