Canadian Justice 3/3: Is the LSO a "racist and failed institution"?

Hamza v Law Society of Ontario is one of the strangest cases in the history of Ontario. In it, the Law Society accused Hamza of being a ‘pseudo-intellectual white supremacist’. Indeed, Hamza is the only lawyer and academic in the history of the colony to be prosecuted on such pretexts. At the same time, the Law Society ordered a “high end” three-month suspension and nominal costs to Everett Ross Field: a neo-Nazi who lied about it. So, what was going on? Why did Hamza and the Law Society engage each other so vehemently, and how was the Law Society so foolish or tricked into making such a manifestly false accusation? The case bears all the signatures of an inside job within the Law Society, as it involves all the major political figures in the legal profession; notably Atrisha Lewis—the leader of the Good Governance Coalition who represented the main accuser, Ish Aderonmu, pro bono—and Ryan Alford: the leader of the opposition (the StopSOP slate) who made the final decision. The context provides some clues about the true nature of the case, which was not the mere outcome of a tussle on social media, but a targeted smear campaign. According to his Law Society profile, for example, Hamza was the only Arabic-speaking trial lawyer in Southwestern Ontario. Attacking him was therefore an attack against the Arab community and their rights. The Star (namely, Ish’s friend Alyshah Hasham) also specifically attacked Wizard of Laws, which specializes in forensics and analytics. Conversely, Hamza’s counterattack didn’t merely target the accusers, but, most importantly, the Law Society itself. Whether these were hit jobs by Zionists or parties seeking to expose the racism of the Law Society is unclear, but most likely. The Law Society initially (and blindly) accused Hamza of being a pseudo-intellectual white supremacist through accusers and judges using their own and each other’s accusations as evidence and conclusions. When the principal accusers (namely Ish and his accomplices) refused to testify, the Law Society called three lawyers who had nothing to do with the original matter to “witness” in their stead. These lawyers were involved in a case with orphan clients of Hamza Law. The orphans, who were not allowed to testify and written out of the record, filed complaints against these lawyers for their inhuman treatment of them and their counsel, which the Muslim community witnessed. The materials at issue are clearly hacks, since the other parties can’t claim to have opened closed documents without admitting to have manipulated them. Nor can they rely on forged documents without proving their accusations to be forgeries. Nor can they rely on their false content without proving they are liars who would (moreover) believe anything false about Hamza and nothing true. In other words, they can’t have Hamza’s cake and eat it, as they did. However, the truth of the matter is not obscure. Three facts are dispositive; namely, (1) none of Hamza’s accusers are connected to him; (2) all are connected to each other; and (3) all are agents of the Law Society who sought to suppress their identities and testimonies. As a result, all of Hamza’s connections are witnesses against them. What is more: in the case of Ish, hundreds of his former supporters testified that he’s a racist grifter. Ish likewise turned against them, accusing them of being genocidal white supremacists, thus confirming his employer(s), especially now that he’s homeless. By their account, there should have been 3,000 witnesses against Hamza (2021 ONSC 580 para 5(d)(vi)); not three slinking trolls for the Law Society. Finally, Hamza’s purpose was almost certainly to show that the Law Society is a “racist and failed institution”, causing it to do everything in its power to save face by attacking him both personally and professionally. So, is it a “racist and failed institution”? In fact, the case shows more than that. It’s a criminal organization whose methods are completely ineffective. For example, it took four years and hundreds of thousands of dollars to figure out that Hamza, who is neither uneducated nor a white European, is not a pseudo-intellectual white supremacist like his accusers and judges.
