The former Chairman of the Joint Chiefs of Staff, made two secret calls to his Chinese counterpart, General Li Zuocheng, during the final months of Donald Trump's presidency in 2020 and 2021.
In the first call on October 30, 2020, Milley stated, "General Li, I want to assure you that the American government is stable and everything is going to be okay."
"We are not going to attack or conduct any kinetic operations against you."
"If we're going to attack, I'm going to call you ahead of time. It's not going to be a surprise."
The second call happened on January 8, 2021, where Milley reiterated assurances of stability and no surprise attacks.
Milley defended these communications during congressional testimony on September 28, 2021, describing them as routine military-to-military contacts coordinated with the State Department and not "secret" in the sense of bypassing the chain of command, however they were not directly authorized by Trump.
Critics, including Trump, accused Milley of treason for potentially undermining presidential authority.
Many are now pointing to the preemptive pardon issued to Milley in Biden's final days in office, The pardon was not personally signed by Biden; instead, White House staff used an autopen on the official warrants.
Biden's chief of staff, Jeff Zients, approved the autopen's use via an email on January 19, writing,
"I approve the use of the autopen for the execution of all of the following pardons."
This has prompted investigations by the DOJ and the House Oversight Committee looking into whether the pardons are valid.
