If you grew up in the ’80s, you knew the rule: Be home when the street lights come on.

Florida Statute 787.03 says it’s a crime if a parent takes a child “without lawful authority.”
But what is lawful authority?
A court order? A parenting plan? A handshake?
The law doesn’t say—and that’s the problem.
Law enforcement can’t act when it’s unclear.
Judges across Florida have called the statute “poorly written” and “hardly a model of clarity.”
So in one county, it’s a felony. In another, it’s ignored. 🙃
Even Florida case law says court orders only work when laws are clear and unambiguous.
And in the middle?
Children—cut off from a parent, emotionally harmed, and trapped in legal limbo. 💔
This law was written in 1975.
Times have changed, families have changed—the law hasn’t.
