Gresham, OR - On June 13, Gresham Police officers and Multnomah County Sheriff's Office (MCSO) deputies responded to several 911 calls about two people fighting at Cameron Park Apartments.
An eyewitness, according to the Multnomah County District Attorney's Office, said a man, identified later as Ladarius Collins, was fighting with his brother in the driveway of the apartment complex and that Collins had a gun. At one point, Collins had pointed the gun at people trying to intervene, then held his brother "by the throat while holding a gun to his brother's head," the witness said. Collins' brother later reported that he had been pistol-whipped in the head. The incident was also recorded on police cameras.
When police began to arrive, Collins ran. Gresham Police issued a probable cause for arrest for third-degree assault, menacing and unlawful use of a weapon.
During the search, a sheriff's deputy, Adam Suboh, located Collins, who was running through the neighborhood and jumping over fences, at one point with his girlfriend.
Later, according to the DA's report, Suboh parked his car, drew his gun and told Collins to get down on the ground. While walking toward Suboh, about 20 feet away, Collins "directly" pointed his handgun at him, and Suboh shot him. Collins "appeared to dive down between two cars," and Suboh saw him lying on the ground with the gun next to him, commanding that Collins move away from the gun to render medical aid, which Collins did not.
Officers were later to provide aid to Collins, who was taken to a hospital, where he was pronounced dead. Collins had been hit by a bullet that entered behind his left shoulder, according to the report, and a Gresham Police detective found that Suboh had fired six rounds.
Suboh, per protocol, was placed on leave, and the East County Major Crimes Team began investigating.
The Multnomah County District Attorney's Office reviewed the evidence, ultimately concluding Friday that Suboh's "use of deadly physical force... was justified, and therefore, not criminal under Oregon law."
