Noah Rothman: If 25th Amendment Is Toothless, There Is Nothing to Restrain an Out of Control Executive Branch and the Country Is in a Bad Position

PERINO: “What do you think about this, a question also in our poll was, is it important for Congress and the Justice Department to investigate Biden advisors on using Autopen? ‘Yes’ was 52%, making key decisions was half and half, and covering up decline, ‘no’ at 55%. That is possibly because people think, ‘We know what happened, we think it was bad, but we don’t think it needs to be investigated.’ But what do you think about that?”
ROTHMAN: “I mean, that is fair. There is a case to be made for that, that the country would be better served by moving on. Tearing at this scab and opening up old wounds does nothing for nation. I can see that argument, the merits of the argument. I think they’re just simply outweighed by the necessity of looking back on this period and determining whether or not the president’s cabinet officials and advisors were ignoring their constitutional obligation. You know, the 25th Amendment is an obligation that is imposed on the president’s subordinates, as well as the president. It is an executive Branch mechanism. And if they were consciously ignoring the triggers that should invoke the 25th Amendment, we need to know that. If the 25th Amendment is toothless, if it has been rendered moot by just the necessities of bipartisanship, that’s a really dangerous condition and the country needs to know it and we need to know how to address it moving forward. Impeachment already as a remedy for malfeasance, and the executive Branch is relatively toothless. If the 25th Amendment is also toothless, there is simply nothing to restrain an out-of-control executive Branch and the country is in a bad position as result of that reality. We just simply need to know it.”
