ALBANY – An appeals court Thursday unanimously replaced the first-degree murder conviction of David T. Agan Jr. with a conviction for second-degree murder, ruling that the screwdriver-wielding killer's butchery of his wife in a Columbia County medical building was not to silence her as a possible witness to his sex crimes.Prosecutors said Agan murdered 37-year-old Christine Agan in a lobby of the Valatie Medical Arts Facility on River Street on Dec. 10, 2015, because she was a potential witness against him in his repeated sexual abuse of a 16-year-old girl, which began in January 2014.

State Police arrested him on Route 4 in East Greenbush following a manhunt. They took him to Albany Medical Center Hospital after fearing he ingested an unknown prescription drug before his car was stopped. exp-customer-logo
Agan, 48, serving 186 years to life in Attica Correctional Facility, will be resentenced as a result of the decision by the Appellate Division of state Supreme Court’s Third Department. The court's decision may not drastically impact his time behind bars. Agan lost his appeal on 139 counts of sex crimes, which include rape and criminal sex acts victimizing an underage teenage girl.
