Former military lawyer with nearly 15 years experience in federal law explains the recent case of Admiral Burke, a retired Navy 4-star who was recently convicted of bribery and other charges in Federal criminal court. Gifts from government contractors are usually bribes in violation of federal criminal law designed to induce the federal government employee to take an official action to benefit the contractor. Conflicts of interest arise when federal executive branch employees take an official action for their personal benefit or for the personal benefit of someone close to them. Financial conflicts of interest are federal crimes.
