In-N-Out Parking Lot Chaos: Armed Felon Shot by Elk Grove Cops After 911 Call

On April 11, 2025, around 11:13 p.m., Elk Grove Police received a 9-1-1 call reporting a man inside a restaurant on Stockton Boulevard who was harassing juveniles and acting erratically. The caller told the dispatcher that she believed the man, later identified as 50-year-old Jerry Tolliver, had a gun in his pocket. When officers arrived on scene, Tolliver was standing at a table outside the restaurant.

The officers coordinated their approach in an effort to keep Tolliver, reported to be armed, from re-entering the restaurant and putting patrons in harm's way. As the officers approached Tolliver, officer #1 said, "Hey, hey, hands up, don't move." Tolliver began to reach into his pocket and officer #1 told him to get his hands out of his pockets.

Tolliver ran between two parked cars with a firearm in his right hand. Officer #2 discharged his service weapon as Tolliver ran into the parking lot and pointed the handgun at the officer. A K-9 was deployed while Tolliver was still in possession of the firearm. A camera in a parked vehicle recorded Tolliver exiting the restaurant and as he walked toward the outdoor tables, briefly raising a firearm above his head before officers arrived.

The video then shows officers arriving as Tolliver runs with the firearm in his right hand, before officer #2 discharges his service weapon and a K-9 is deployed. Officer #2 had a view of Tolliver outside the restaurant and was advising other officers of his location.

After officer #2 said, "Show me your hands", Tolliver emerged from between the parked vehicles holding a gun in his right hand. Officer #2 discharged his service weapon. Officers provided medical aid until relieved by paramedics. Tolliver was taken to the hospital in serious condition but is expected to survive. Tolliver's .38 special was fully loaded with six live rounds. Tolliver was arrested and is now facing charges filed by the district attorney's office:
