The Attorney General of Canada has brought a motion to strike the judicial review application filed by Rebecca on March 7, 2025, which challenges the September 9, 2024 appointment of Mark Carney as Special Advisor and Chair of the Liberal Party’s Task Force on Economic Growth. The Crown argues the application is without merit for two primary reasons:
1. that the Liberal Party of Canada is not a “federal board, commission or other tribunal” subject to judicial review under the Federal Courts Act; and
2. that the appointment does not create legal rights or obligations, nor does it directly affect the applicants.
On that basis, the Attorney General submits the application falls outside the jurisdiction of the Court and should be dismissed without leave to amend.
While some critics have attempted to dismiss Rebecca’s application as meritless, such criticism miss the point of this claim. The purpose of this judicial review is precisely to compel the federal government to define who the relevant parties and actors are—and to clarify the legal nature and standing of those involved. If political parties are private entities, then serious constitutional questions arise: In a constitutional monarchy governed by the British North America Act, 1867, how can the leader of a private organization assume the office of Prime Minister of Canada?
