How The German Government Uses The Justice System To Instill Fear Among Citizens: Attorney Schmitz
In Germany, government leadership considers Freedom of Speech so dangerous that they are determined to ‘protect freedom from itself.’
Civil rights Attorney Dirk Schmitz says: “I didn't just make that sentence up, it's actually been used several times in court rulings. It means: if I allow people a freedom I consider suspect, they could endanger freedom, and before they endanger freedom, we don’t allow them to speak before they can commit a speech crime.”
Schmitz has been defending many citizens in Freedom of Speech prosecutions in Germany over the last years. Citizens are now prosecuted more and more often for not just posting content that is considered offensive by political leaders but they are also prosecuted for reposting content: “Originally, the internet was like one big meadow. Practically like the Wild West. And this Wild West is now being ‘civilized.’ Nowadays they’re trying in Germany - and not just there but also in the English-speaking and Arabic-speaking world - to surveil the entire internet.”
The Digital Service Act (DSA) is the EU’s cudgel to suppress and punish free speech on the internet - not just in EU countries but worldwide: “The DSA, that's an imperialist act – worldwide. According to the legislation, the DSA does of course apply only to the territory of the European Union. That’s correct. The act applies to legislation, of course, every EU law only applies to the territory of the EU. That's clear. But it does of course impact other countries, including the US.”
And not only that: top politicians in Germany’s government personally file criminal complaints against citizens. For example, former Vice-chancellor and Minister for Economic Affairs and Climate Action Robert Habeck personally filed over 500 criminal complaints against German citizens for posting and reposting ‘crimes’ and Nancy Faeser, the Minister of the Interior until May 6, 2025 filed more than 700 such criminal complaints.
Most prosecutors and judges in Germany’s legal system obediently follow the orders given by the political elite: “There is an increasing conformity of the prosecutors, but also of the judges. Because in Germany they're not elected, they're all appointed by the state. All judges in Germany. And with judges, every now and then you have a good district judge among them. That's someone who's between 50 and 60 years old. He doesn't aspire to work for the higher courts anymore, he doesn't want to pursue a career anymore. And he says outright, ‘you can all go to hell, I’m going to do what’s right.’”
Nancy Faeser has been organizing so-called ‘Action Days Against Hate Crimes’: “Recently there were very large demonstrations 30,000, 50,000 or 100,000 people. Within four days, 100,000 people were on the streets. They were largely paid for by the government, like in the worst times of socialism. Not that the Federal Minister of the Interior transferred money to them directly, but the NGOs paid for the buses and even paid people money for every day they participated in demonstrations.”
