As of November 2023, alkaline hydrolysis, also known as aquamation or water cremation, is legal in the following U.S. states:
Alabama

Arizona

California

Colorado

Connecticut

Delaware

Florida

Georgia

Hawaii

Idaho

Illinois

Kansas

Maine

Maryland

Minnesota

Missouri

Nevada

North Carolina

Oklahoma

Additionally:
Michigan allows it in practice, though no explicit laws regulate it, and some funeral homes offer the service, possibly using out-of-state facilities.

Kentucky, Massachusetts, Pennsylvania, South Dakota, Texas, and Wisconsin have legislation pending to legalize or regulate alkaline hydrolysis.

New Hampshire explicitly bans alkaline hydrolysis, having repealed its legalization (2006–2008) due to religious opposition.

Idaho, Kansas, Maryland, and Vermont have legalized it, but no active practitioners are currently available in those states.
