Judge Napolitano shames Marco Rubio for deportations - April 15, 2025

Newsmax contributor Judge Andrew Napolitano says Secretary of State #MarcoRubio should be ASHAMED of himself for deporting #MS13 gang member Kilmar #AbregoGarcia who had been detained in an #ICE raid on a home that housed other MS-13 gang leaders. #AndrewNapolitano is CONSTANTLY on Newsmax, mostly during their morning shows, to argue on behalf of #KilmarAbregoGarcia. The question is: Why? Doesn't CNN and MSNBC do enough? #PresidentTrump never nominated Judge Andrew Napolitano to be on the Supreme Court, so maybe that's why he is always critical of Trump through all his trials and hearings.

TRIBE: If he [Kilmar Armando Abrego #Garcia] is not released in the next few days, that will be a signal to everyone in the country that they can be detained indefinitely by stalling maneuvers on the part of the #Trump administration, or any future presidential administration, unless courts get there before the government can move. It's a very deadly game in which the government is told, if you take people who are perhaps ideological opponents of the administration, immigrants, citizens, what have you - people that the government would like to get rid of the way people have been disappeared to gulags throughout history - [My Note: Or mentally ill or disabled people, or Jews, in Nazi German] if you want to get rid of them, here's how you do it. You just grab them quickly and disappear them. That's where we will be if he's not returned.

NPR: And are you worried that could apply to American citizens as well as people in the country on any variety of immigration statuses?

TRIBE: Absolutely. Even if you are a citizen, when the government has grabbed you and taken you on a flight to nowhere, the fact that you might be a citizen is something they can contest. Oh, we don't know for sure that he was a citizen or that she was a citizen. How do we know? The whole point of due process is to make sure that what the government claims about you is true.

While Garcia may have married an American citizen after illegally entering the U.S., marrying a U.S. citizen does not automatically grant someone who entered the country illegally legal permanent resident status (Green Card). While marriage to a U.S. citizen does make an individual an "immediate relative" and eligible for a Green Card, several factors can complicate the process and make it difficult to obtain legal residency.

In the recent Supreme Court ruling, nothing is mentioned about his status as being permanent resident or having a Green Card.
