Justice Roberts Rules Against Order To Return Illegal Migrant To U.S. From El Salvador

Chief Justice John Roberts has put a pause on a lower court's ruling that oredered the Trump administration to return an illegal migrant that was shipped out to El Salvador with violent Venezuelan gang members.

Kilmar Armando Abrego Garcia is originally from El Salvador and came into the country illegally about 13 years ago. Immigration officials say he is a member of MS-13 – which is why he was deported back to his home country.
Roberts' order comes after the Trump administration asked SCOTUS to step in, and gives the Supreme Court more time consider the issue.
The DOJ requested the emergency relief after a lower court judge ordered Abrego Garcia to be returned to the United States – asking the high court to block the order saying it "sets the United States up for failure" because it cannot force the President of El Salvador to "follow a federal judge's bidding." And return a citizen of El Salvador to a country he entered illegally.
The filing states,
"The Constitution charges the president, not federal district courts, with the conduct of foreign diplomacy and protecting the nation against foreign terrorists, including by effectuating their removal"
Abrego Garcia was arrested in 2019 alongside three other men in Maryland - he was detained by federal immigration authorities while an immigration judge examined his case.
The judge in the case denied his request for release on bond, which was upheld by an immigration appeals board.
