Emergency Act Lawsuit - Against Justin Trudeau!

In January of 2024, a landmark decision from the Federal Court ruled that Trudeau's use of the Emergency Act to crush the Freedom Convoy was unconstitutional. immediately after that decision was released, a brave group of citizens who had their bank accounts frozen due to the use of the Emergency Act, filed to sue the government, the banks, and key Ministers personally, for their involvement.

This is a groundbreaking case headlined by some very important individuals, including former OPP officer Vincent Gircys and Canadian military veteran Eddie Cornell. I was able to sit down with Vincent Gircys and Kerri Haines, two plaintiffs in this case to get all the details.

This case involves a representative group of 20 different plaintiffs from across Canada. All were mistreated by the government due to the Emergencies Act, and most had their bank accounts frozen. Some of them were in Ottawa, some were not, some were supporting the protest, and some were not. It goes to show you how wide a net the government threw in using their extraordinary powers, and they targeted many people who had no immediate connection to the convoy.

According to Vincent Gircys, not only are they suing the government, they are suing Justin Trudeau, Chrystia Freeland, Anita Anand, and Marco Mendocino personally, along with Ottawa Police Service, Chief Bell, Ottawa Police Service Board, RCMP Superintendent Beaudoin in charge of financial crimes, RCMP, and the banks.

This case is one of the few cases actually going after the government, and the only case to my knowledge individually naming Justin Trudeau and his cabinet ministers in their attempt to seek justice. Given their evidence, and the decision of the Federal Court ruling the acts use was unconstitutional, they have a very strong case.

Vincent goes on to explain that even without the court ruling that the Emergency Act was used unconstitutionally - they still have a great case.

This is great news, because this court decision is currently under appeal by the Government. Vincent is confident that this appeal will not overturn the decision, but even if it did, Vincent explains that they still violated the Emergency Act itself.

Hundreds of people across Canada had their accounts frozen. Some were connected to the convoy, and some were not. Vincent explains that the RCMP working in conjunction with other police services, the Prime Minister and Cabinet Ministers, and with the big banks, took it upon themselves to freeze the bank accounts of hundreds of people without going through any judicial process.

Vincent tells me, right in the act itself, it declares that it must operate pursuant to the Canadian Charter of Rights. In this case no police authority went through any judicial process or went before a judge to expose any reasonable grounds for freezing these bank accounts. He says they did not act on reasonable and probable grounds, or even reasonable suspicion, and they did not have evidence that a judge would require to freeze a bank account. They just randomly selected people and provided personal financial information to the institutions, which was passed all over the world for the purpose of freezing their bank accounts.

The Justice Mosley decision on the Emergency Act declared that the government acted unlawfully. Though this is being appealed, Vincent expects a decision within the next 2-3 months, and he and his team are highly confident that they will get a favourable decision.

Often many of you ask me why we cannot go after politicians and government ministers personally for their decisions that damage the country. Why isn't Trudeau in jail you ask me? The answer is that there is typically a high bar for holding government officials personally accountable for their actions.

But this case takes the extraordinary step of not only suing the government, but going after Trudeau and many of his Ministers, and certain police chiefs - personally and individually. This is a gamechanger.

Vincent says the evidence is there to show that they were acting together and in harmony, and the damages they caused as a result of their conspiracy and working together, ought to have been known that it would cause the damage it did.

Kerri Haines also tells her story. Her husband was in Ottawa, but left before things got crazy in Ottawa. But then later all of a sudden they lost access to all of their bank accounts, credit cards, and everything financial.

The local bank branch had no idea what was happening, they were given no notice, and they had no idea how long it would last.

She tells the story of 81 year old Peter, whose wife, not even at the Convoy, had her account frozen and couldn't buy groceries.

Other stories I'm aware of include parents who had to buy important heart medication for their son with cash due to their bank accounts being shut down.

These stories and hundreds more like them are outrageous. This case has a great chance of success due to the Federal Court decision, but also because they've documented how how due process was completely thrown out the window.

Overall, I think there's great chance of success, and I'm very excited about this case.
