Atty. Robert Barnes Weighs in on Due Process and the Deportation of Undesirable Non-Citizens
Wong Wing Case – Due Process Can’t Limit Deportation – No limits can be put by the courts upon the power of Congress to protect by summary methods the country from the advent of aliens whose habits render them undesirable as citizens or to expel such aliens if they have already found their way into land and unlawfully remained there. Wong Wing v. United States was a landmark Supreme Court case decided on May 18, 1896, that addressed the constitutional rights of non-citizens in the United States.
He mentions the Obama administration's drone strike killing of Anwar al-Awlaki, an American citizen, without due process.
