IRS Whistleblower Who Exposed “Antiquated Systems” Placed on Leave; CJF & Citizen AG Provide Support
At the Citizen Journalism Foundation, we are committed to protecting whistleblowers who expose critical truths about government agencies and corporations. Our latest case involves David Nelsen, a Tax Examining Technician at the Internal Revenue Service, who stepped forward to reveal concerns about the agency’s outdated and “antiquated systems” that “handcuff” employees from effectively serving the public. Nelsen has been placed on “paid administrative leave” while the agency “investigates” his conduct, according to a letter he received on March 14, 2025.
"The latest status is that we just received a letter… indicating that he would be placed on paid leave while the agency is investigating his conduct," said Nicole Pearson of Citizen AG "Which is interesting language because they need to be investigating… his claims and the basis for his plans, and not his conduct."
Pearson and Citizen AG have taken proactive legal measures to ensure Nelsen’s rights are protected. "First and foremost, we have sent a letter of representation, informing the IRS, the Treasury, and other involved agencies that we do represent him and that we are watching him specifically," she stated.
She emphasized that they are well-versed in whistleblower protections and will be closely monitoring the agency’s actions. "If they don't [protect his rights], we are prepared to step in and do so on his behalf."
Nelsen’s case is particularly significant because he was exercising his rights under the IRS Internal Revenue Manual (IRM) Section 7.5.3.3(2), which allows employees to express opinions on matters of public concern. Additionally, the Whistleblower Protection Act and the Whistleblower Protection Enhancement Act safeguards federal employees from retaliation when exposing violations of law, mismanagement, or abuse of taxpayer funds.
The Citizen Journalist Foundation and Citizen AG continue to stand by whistleblowers like Nelsen, ensuring their voices are heard and their rights are protected. "We are here again to expose and hold these agencies accountable… and that you have tools and a team at your disposal to help protect you," Pearson affirmed.
