WITT: “Peter, why did the White House put out this clarification of sorts? I mean, his signature appears on the proclamation in the federal register. And is it really Rubio driving this and not Trump, or is he scapegoating secretary Rubio?”

BAKER: “Well, it’s a matter of confusion, right? The president. United. States obviously didn’t seem to understand that he had signed this order himself. He doesn’t seem to know what he’s signing. That tells you something, right? We talked a lot about the last president and his slippage as he got older. Well, this president is 78. And the question that therefore is obviously raised as to what he knows he’s doing, and does he know what he’s signing now, that doesn’t mean he disagrees with this. I think he actually does agree with this. He might not have remembered or might not have focused on the fact that he was signing this, but this is definitely his policy. Rubio is the agent to make it happen. But this is Trump’s policy. And I think it’s you know, it’s telling because remember, he accused President Biden of using an autopen to sign the pardons in his last day in office and therefore said that those pardons were somehow legally suspect or even negated, he said, because they were not signed directly by the president. Nothing in the Constitution, of course, says that a signature has to be direct or autopen doesn’t address that. And the Justice Department opinion in 2005 said an autopen is perfectly fine for a president if he chooses to use it that way. But President Trump is the one who made an issue out of the fact, out of whether or not Biden himself had signed and then, of course, seemed not to understand that he had signed this particular proclamation.”
