It’s been another exciting week in the courts as the 2-day hearing wrapped up today for JCCF prorogue federal court challenge. The final decision is pending.
The JCCF was representing two men from Nova Scotia to challenge the Royal prerogative of the Governor General to prorogue Parliament. The JCCF claims the prorogue is Ultra Vires of the Prime Minister’s role.
The case hinged on Constitutional conventions that are not binding in the courts and various common law, including one of our favourites, Roncarelli v Duplessis, and most notable in this case was Miller from the UK in 2021 regarding Brexit. However, in order for the judiciary to challenge a constitutional convention the arguments must be based on a legal provision. Did they find that legal provision?
If the JCCF is successful, this would fundamentally shift the parliamentary power to the courts from Parliament. This would set a **dangerous** precedence that would place a single judge over Government.

Tonight, we’ll dig into the arguments AND how this case lays the foundation to challenge Mark Carney becoming PM without being elected.
