The Minneapolis City Council has approved a settlement after a lawsuit was filed accusing former Minneapolis police officer Derek Chauvin of using excessive force in the arrest of a 37-year-old woman in January 2020 – months before George Floyd was murdered.
The council unanimously approved the $600,000 settlement after a lawsuit was filed by Patty Day, a former city of Minneapolis employee.
Day admits she had been drinking in January 2020 when someone called 911 to report a female who appeared intoxicated had gotten her car stuck in the snowbank in south Minneapolis. She said she was pulled from her car without being asked to get out.
Day’s attorneys say Chauvin “violently yanked Patty from her vehicle and, without justification, threw her to the ground in the middle of the street, fracturing her tooth, injuring her arm and shoulder, and causing other significant injuries before handcuffing her.” The complaint also alleges the other officer who responded, Ellen Jensen, did not intervene.
Chauvin used what Day's attorneys described as his "signature pose" - pressing his knew into her back while she was handcuffed. Chauvin used a similar action months later resulting in the death of George Floyd.
“While no settlement can undo what Patty endured, we are grateful to have reached an agreement that holds the officers accountable for their actions,” said Katie Bennett, partner at Robins Kaplan, in a statement. “This case is yet another example of the critical need for justice and reform in policing.”
