Prove Biden was never elected in the first place and his pardons would be invalid. That would probably get wrapped up in court for years but it still is worth doing. Concerning pardons: Is treason pardonable? In other words can Milley be charged with treason?

Fitton's comment seems like common sense. If Milley robbed a bank he couldn't use Biden's pardon to get out of it. The DOJ could just be clever about how they define their investigation. On the other hand the J6'ers had specific charges that were pardoned and Garland isn't around anymore to do anything about it.

The DOJ should sue to overturn those “pardons.” They’re unconstitutional. Pardons are for people found guilty in a court of law. Otherwise it’s immunity.

How can someone be pardoned who has not been charged? It's right up there with declaring a 28th Amendment on a whim. Saying it doesn't make it so. I hope the Trump Admin pursues this hard. Those people need to be investigated thoroughly. I have a personal friend who was amongst the 1500 J6 "hostages." He lost his job, livelihood, and freedom - under house arrest for the past 2 years for simply being there on the day. This was a huge injustice and someone needs to pay for it.

The biggest overall challenge to the blanket pardon is that it elevates those who are pardoned to be above the law, rather than being forgiven for possible errors in their behavior. That may well be beyond the authority of pardons.

There is NO such thing as a "pre-emptive" pardon in our legal system, and that includes the case of Nixon. Ford's pardon for Nixon was never applied because he was never indicted, prosecuted, or convicted. Had he been, THEN a pardon would have been accepted, or not, and applied or rejected. In addition, anyone accepting a pardon admits guilt for the crime for which they were convicted (Burdick v. United States, 236 U.S. 79; 1915). Since most of these "pardonees" have NOT been indicted or convicted of anything, Biden's "blanket/pre-emptive" pardons DO NOT APPLY. If they accept one of these worthless pardons, they must be forced to go public and admit the crime for which they are accepting it.
