SCOTUS Upholds Ban on PRC Ownership/Influence of TikTok

The Protecting Americans from Foreign Adversary Controlled Applications Act was signed into law on April 24, 2024 by President Joe Biden. The law bans social networking services within 270 to 360 days, from signing, if they are determined by the president of the United States and relevant provisions to be a "foreign adversary controlled application." The definition covers websites, application software, algorithm, and mobile apps.

The only social media company of note that would be affected by this situation is TikTok, through it's parent company ByteDance, which is a Chinese Company with ties to the Communist Party of China. The national security threat of TikTok is not just in the algorithm, but also the permeation of the mobile app which gains access to the user's phone in nearly an entirety, including multiple military members and other government officials.

TikTok did have an option available to it in order to stay in the US market: divest any interest being held by the ByteDance and remove influence from the Communist Party of China. The deadline for this was January 19, 2025.

On May 7, 2024, TikTok and other content creators on the application filed a lawsuit in the D.C. District Court and began the fairly fast trek to SCOTUS. Oral arguments were heard on January 10, 2025 and then the opinion was rendered on January 17, 2025.
