So, I am not understanding. Merchan said that the evidence associated with presidential immunity did not substantially taint the case. Davis thinks that the whole case was thrown out because of the earlier SC decision on immunity. Wasn't it proper for the SC to say in effect that this will be sorted out on appeal, i.e. whether or not the verdict was tainted by evidence tainted by immunity? It does seem like the whole case is ridiculous; Dershowitz said after 60 years he can't explain the case when someone asks. Still, doesn't this have to play out in the courts? It is possible Merchan is just being political, but Davis has nothing other than argument ad hominem, against both the judge and those whole ruled against Trump on the SC. Can someone please make a detailed expert legal case, because that is the goal, right, to fight law-fare with law, not with mere rhetoric.

There is an obvious huge, incredibly insane, serious problem, with our judicial system when an abuse and misuse of the law can take place over years at the expense of a U.S. citizen who has no ability to put a stop to it when there is already a Constitutional means to do so because of Article III. The Constitution in Article III states that “The judicial Power of the United States, shall be vested in one supreme Court…The judicial Power shall extend to all Cases” clearly implies that SCOTUS should have, and does have, the authority, responsibility, and duty to act if no lower official does not take immediate action to stop this farce and any of the others created to persecute and attack Trump or any American. SCOTUS should be ashamed for doing nothing and Congress should pass the legislation that requires and supports the Justices to use the Power given to them in the Constitution to ensure this type of misuse and abuse of the law is cut off quickly and all those involved are held accountable and receive serious consequences. SCOTUS failure to act at the front end of this case screams about the insane logic that is currently allowed and embraced to decide to do nothing to Merchan and Bragg. It borders on judicial mental illness when they claim the case must go through the proper process so it can set a precedent to prevent future abuse and cowardice when they make claims of standing. There is no excuse for any superior judicial official from acting immediately to stop this crime. Yes, all up to and including SCOTUS have committed a crime and should be held accountable with removal from office, jail time, and fines with high financial restitution to Trump. If it can go on this long for a former and reelected President, an ordinary American citizen would probably be killed by the process. It is just another form of sanctioned assassination that should be treated with the utmost harsh response. Barrett and Roberts should be impeached.

Now from a legal standpoint, Donald Trump Is Innocent, There Was NO Corpus Delicti, this is a Latin phrase that means "body of the crime". It is a legal principle that requires evidence to prove that a crime occurred before a person can be convicted. Another legal standpoint, the appeals court will now have this bullshit case before them' and most likely end the charade of lawfare. This should be tossed out based on Donald Trump's innocence. There was jury tampering, The civil rights of the soon to be Donald J. Trump POTUS were violated regarding his free speech, And Trump not having the right to testify with an UN-Constitutional Gag order Inhibiting Preventing His Free speech. Even Donald J. Trump's attorneys were prevented from presenting a proper defense, Crook Judge Juan Merchan, violated a code of ethics and should be disbarred, arrested indited charged found guilty and sent to prison for election interference for at least 5 years. Judge Juan Merchan’s law license revoked, and never to be part of the criminal justice system ever again. Restitution should be paid back to President Trump for all legal expenses and that election and free speech interference in violation 1st amendment and preventing and the presentation of defense his right to testify. Judges need to be rotated between assignments in much the same way that military officers are rotated through different command posts. Every 4 years each judge should be compelled to move to a new jurisdiction assigned to him/her, or retire. This prevents allegiances from developing and creates judges that are replaceable units able to remain uninvolved in local politics. It increases judicial diversity by randomizing assignments. The position becomes independent of the current occupant.
