Legal Rights and Judicial Accountability:

In accordance with established legal principles, including those articulated by Lord Diplock, criticism of the judiciary must not amount to scandalising the court unless such criticism is baseless or made in bad faith. However, judges, like all public office holders, are not above the law and must be held accountable for any criminal conduct, including malfeasance and misconduct in public office.The Rule of Law is our Constiutional Human Right.

Under UK law, malfeasance in public office is recognised as a criminal offence. It occurs when a public office holder willfully and knowingly abuses their position to cause harm, injustice, or financial loss. This includes deliberate wrongdoing by judges and public officials. The elements of the offence were summarised in Attorney General's Reference No 3 of 2003 [2004] EWCA Crim 868. The offence is committed when:

a public officer acting as such

wilfully neglects to perform their duty and/or wilfully misconducts themselves

to such a degree as to amount to an abuse of the public's trust in the office holder

without reasonable excuse or justification

Additionally, perjury, as defined under the Perjury Act 1911, (1A) is a criminal offence committed when an individual, including barristers and solicitors, knowingly makes false statements under oath or falsifies court documents with the intent to mislead or misrepresent facts. Such actions undermine the integrity of the judicial system and constitute serious criminal offences. The Fraud Act 2006 (s2), Domestic Violance Act 2021 and Serious Crime Act 2015 (s76) is a criminal offence which this video provides primary material evidence.

This publication highlights these legal principles to ensure transparency, uphold justice, and remind all stakeholders of their legal and ethical responsibilities in maintaining public trust in the judiciary.
