Metro police released video and information on a Christmas Eve barricade that resulted in an officer firing his weapon at an armed man.
Assistant Sheriff Fred Haas said officers were called to a disturbance at a mobile home in the 3200 block of La Barca Lane, near E. Desert Inn Road and S. Nellis Boulevard, shortly before 8 a.m. The disturbance involved 65-year-old Donald Eubank and his brother. Haas said Eubank was evicting his brother from the property.
Police stood by while Eubank’s brother collected his items and left, but police received another call about a disturbance a few hours later when Eubank’s brother returned with a woman to retrieve more items from the home. They notified police that Eubank had guns.
“Donald exited and entered his residence multiple times from both sides of his residence during this incident,” Haas said. “He continued to yell at our officers and refused to comply with our demands.”
During one of Eubank’s exits from the home, he slashed the tires on a police vehicle and broke the back window, he said.
”Prior to SWAT’s arrival, Donald again exits the residence armed with a long gun and points it towards the officers. Officer Christian Espinoza fired his weapon at Donald but does not strike him and Donald goes back inside the residence,” according to Haas.
Espinoza’s body-worn camera captures the non-lethal rounds fired at Eubank leading up to the two rounds fire by Espinoza.
At one point, Eubank goes back outside and appears to retrieve some clothing. SWAT who was also at the scene was eventually able to take him into custody after using a TASER.
Eubank who remains in the Clark County Detention Center as of noon Friday is facing felony charges of assault with the use of a deadly weapon, resisting a public officer with a firearm, assaulting a protected person with a firearm, and tampering with a vehicle.
Jimmy Eubank told 8 News Now that his brother Donald had just been released from a rehabilitation center before the barricade took place. Eubank remains in the Clark County Detention Center and is scheduled to be in court on Dec. 31.
