Posted • December 9, 2024: DEFAMATION: Defamation: Tammy Duckworth claims without any evidence that Tulsi Gabbard is compromised. Tulsi should be able to force Tammy to present evidence or pay her. Even under the ridiculously permissive defamation standards imposed by the Supreme Court in NY Times v. Sullivan—a 1964 ruling that should be revisited—this might be actionable defamation, as I suspect Tulsi Gabbard could show she was defamed with reckless disregard for the truth. How many big defamation suits is CNN already facing? Gabbard had better file quickly.
