Daniel Penny manslaughter charge dismissed as jury breaks for weekend

Jurors in the Daniel Penny trial remain deadlocked on the top charge of second-degree manslaughter after four days of deliberations.

Penny, a 26-year-old Marine veteran, is accused of killing Jordan Neely, a homeless man with schizophrenia, during a subway incident where Neely threatened passengers.

Unable to reach a unanimous verdict, the judge dismissed the manslaughter charge, allowing deliberations to continue Monday on the lesser charge of criminally negligent homicide, which carries a maximum sentence of four years, Fox News has reported.
