A Jackson County man who shot himself in the hand while being tased after he allegedly pointed a gun at a deputy is heading to circuit court for trial.
The case against James Mitchell Kerr was bound over to the trial court Wednesday, Nov. 13 after a preliminary examination before Jackson County District Judge Michael Klaeren, according to the Jackson County Sheriff’s Office.
Kerr, 41, is charged with assault with intent to murder, carrying a firearm in the commission of a felony and resisting arrest.
The case stems from an alleged probation violation. Deputy Robert Henderson, with a warrant, went to arrest Kerr on Sept. 19 in Leoni Township for the alleged violation.
Kerr had a warrant for failing to pay child support. He also has a pending case in circuit court for possession of methamphetamine, court records show.
Henderson found Kerr on a riding lawnmower and told him to get off of it, but he refused, instead accelerating the lawnmower in an attempt to get away, police said.
The deputy chased Kerr on foot until the lawnmower came to a stop in a nearby ditch, police said.
Henderson pulled out his Taser and ordered Karr to comply, or he would be tased. Kerr continued to ignore the deputy’s commands and began walking away, police said.
Kerr then returned to the lawnmower, pulled out a handgun hidden on it, and allegedly pointed it at the deputy. Henderson fired his taser at Kerr, causing Kerr to shoot himself in the hand with the gun, police said.
Backup arrived and arrested Kerr, first taking him to Henry Ford Jackson Hospital to be treated for injuries deemed non-life threatening, then to the Jackson County Jail, police said.
Due to the nature of the incident, the sheriff’s office requested the Michigan State Police do the criminal investigation while the sheriff’s office did its own internal investigation, police said.
The prosecutor’s office authorized charges against Kerr on Oct. 23, and the investigation into Henderson’s actions found them to be justified with no policy violations observed, according to the sheriff’s office.
