The National Association of Realtors (NAR) has been at the center of a significant legal battle over real estate commissions, with widespread implications for the industry. In a landmark case, a jury awarded $1.78 billion in damages, ruling that NAR and major brokerages, including Keller Williams and HomeServices of America, conspired to maintain higher real estate commissions. The case, part of the larger Sitzer/Burnett lawsuit, focused on NAR’s policies, such as mandatory commission-sharing, which plaintiffs argued inflated transaction costs for sellers by requiring them to pay buyer agent commissions even when those agents did not add sufficient value.
