The previous local government finance act 1988 has not been repealed it is used for business rates, council tax was produced to tax peoples property - but this must be within the remit of the LGFA 1988 AND GRA 1967 definitions.
The councils will claim council tax is a primary debt = if so there has to be evidence of an agreement... and that is something that is coming along in due course.
