2023-03-26: In Discussion With WA Police At The Scene Of An Arrest

Original footage recorded on Sunday 26th March 2023 at 1:10am of a discussion between myself and a police officer at the scene of an arrest. I thank the police I encountered for their courtesy and professionalism and for upholding my right to film.

Northbridge is the primary entertainment and nightlife district in Perth, Western Australia where many restaurants, bars and nightclubs are located. Unfortunately it has a reputation of anti-social behaviour and violence especially after certain times of the night due to those who appear to have something to prove and due to the 'drink 'til you drop' culture that some partygoers adhere to.

None of the police officers on duty on the night appeared to have any issues with me filming. In my experience there appears to be a lack of consistency of knowledge amongst various police officers in Western Australia on the rights of members of the public engaged in public videography and the reactions of individual police officers can vary a great deal towards members of the public engaged in the activity. The purpose of this video is to document the reality of life on the city streets for those who are interested in viewing it.

It is not designed to cause alarm or distress nor is it designed to disrespect or exploit those involved in any captured incident.

I believe citizens deserve to know what occurs on their city streets in a raw and uncensored manner (within reason) that is free from the spin, sensationalism and bias of the mainstream media.

There is no expectation of privacy in public. In regards to s. 137(3)(b) of the Criminal Investigation Act 2006, which entitles an arrested person “to a reasonable degree of privacy from the mass media”, I am not a member of the “mass media”. I am an independent videographer with a limited audience and I do not work nor have I ever worked for any mass media organisation.

Such legislation is not designed to prevent independent videography nor is it designed to preclude governmental authorities and their employees from transparency, scrutiny and accountability.
