Utah has launched a significant legal challenge against the federal government, seeking control over 18.5 million acres of "unappropriated" land within its borders. Governor Spencer Cox and Attorney General Sean Reyes argue that Utah, not distant federal agencies, is best equipped to manage these lands. They emphasize the importance of local control, stating that the state can better address environmental concerns, infrastructure needs, and public safety. The lawsuit, now before the U.S. Supreme Court, questions whether the federal government has the right to hold these lands indefinitely without clear use or purpose.
The lands in dispute make up about 34% of Utah's territory and are currently managed by the Bureau of Land Management. The state argues that federal control hampers its ability to perform essential functions, such as fire prevention and infrastructure development, and results in significant lost revenue. Utah leaders, including Senate President Stuart Adams and House Majority Leader Mike Schultz, criticize federal management as ineffective, citing road closures and poor land stewardship. Critics of Utah's lawsuit, including the Center for Western Priorities, argue that the state forfeited its claim to these lands when it joined the Union and that only Congress has the authority to transfer federal lands.
